Couchbase Capella Feature-Specific Terms

These Couchbase Capella Feature-Specific Terms (“약관")는 특정 특징 및 기능(각각 "기능")에서 또는 이를 통해 액세스할 수 있는 카우치베이스 카펠라 클라우드 서비스("Capella (카우치베이스 카펠라)”). By accessing or using a Feature, you agree to these Terms on behalf of the applicable entity or organization you represent. These Terms are incorporated by reference into the executed agreement between you and Couchbase, Inc. (“Couchbase," "우리" 또는 "우리”) which governs your use of Capella, if applicable, or otherwise the Master Service Agreement and Capella Supplement available at https://www.couchbase.com/legal/agreements수시로 업데이트되는 경우(각각의 경우 "동의"). 본 약관에서 정의되지 않은 대문자로 표기된 용어는 본 계약에서와 동일한 의미를 갖습니다.

I. Artificial Intelligence Functionalities

This section applies to artificial intelligence functionalities accessible in or through Capella, including those currently branded as Capella iQ and Capella AI Data Plane.

1. 정의.

  1. "고객 의견'는 귀하 또는 인증된 사용자가 기능에 입력하는 텍스트 또는 기타 프롬프트(검색어 및 명령어 포함)를 의미합니다.
  2. "기능 출력'는 고객 입력에 대한 응답으로 귀하에게 제공되는 텍스트 또는 기타 출력을 의미합니다.
  3. "LM” means a Language Model.

2. 기능 사용.

  1. Depending on how you configure and use Capella and the Feature, Couchbase shall transmit Customer Input to an LM offered by a third-party service provider, an LM embedded within Capella, and/or an LM that you connect to Capella. Couchbase may modify Customer Input by conveying additional directions or context to the LM.
  2. Until further notice and notwithstanding anything to the contrary in the Agreement, unless you purchase an applicable support entitlement (e.g., for a current AI Data Plane subscription) the Feature is provided without support or performance guarantees of any kind. This means Feature downtime shall not be included in Downtime and therefore shall not result in eligibility for Service Credits.
  3. Without limiting the generality of the Agreement, you may not: (i) use the Feature in a way that infringes, misappropriates, or violates any person’s rights or violates any usage guidelines (including any applicable LM provider terms of use), or to perform or facilitate dangerous, illegal, or malicious activities; (ii) reverse assemble, reverse compile, decompile, translate, or otherwise attempt to discover the source code or underlying components of models, algorithms, or systems of the Feature (except to the extent such restrictions are contrary to applicable law); (iii) use Feature Output to train or develop models that compete with Couchbase software or compete with any associated machine learning models or related technology; (iv) use any automated or programmatic method to extract data or output to from the Feature, including distillation, scraping, web harvesting, or web data extraction; (v) represent that Feature Output was human-generated; or (vi) send Couchbase any (I) personal information of children under the age of 13 or otherwise under the applicable age of digital consent, or (II) information that includes or constitutes “Protected Health Information,” as defined under the HIPAA Privacy Rule (45 C.F.R. Section 160.103), in each case without prior written agreement by us.
  4. 귀하는 기능을 사용하여 개인 데이터를 처리하는 경우 (i) 귀하는 CouchBase 및 제3자 서비스 제공업체에 해당 개인 데이터를 처리하도록 지시하고, (ii) 본 계약에 포함된 DPA가 CouchBase의 해당 개인 데이터 처리에 적용되며, (iii) 본 기능을 제공하는 데 사용된 제3자 서비스 제공업체가 승인된 하위 처리자(DPA에 정의된 대로 해당 용어)로 추가된다는 데 동의하는 것으로 간주합니다.

3. 고객 의견에 대한 책임.

  1. 고객 입력에 대한 책임은 전적으로 귀하에게 있으며, 귀하는 고객 입력 제출에 필요한 모든 권한과 라이선스를 보유하고 있음을 진술하고 보증합니다.
  2. You are solely responsible for determining whether you will use an LM in connection with your use of Capella, and for establishing and enforcing policies and procedures regarding how your Authorized Users access and use the Feature.

4. 기능 출력 사용에 대한 책임 및 보증 면책 조항.

  1. You are solely responsible for reviewing and determining whether and how to use Feature Output.
  2. You acknowledge that (i) use of LMs and the Feature may involve risks, including the generation of inaccurate or harmful outputs; (ii) the Feature may generate content that does not reflect Couchbase’s views; (iii) Couchbase does not review or evaluate the quality or accuracy of Feature Output; and (iv) Couchbase makes no representations or warranties regarding the quality or accuracy of Feature Output. Feature Output may not be unique across users and the Feature may generate the same or similar output for a third party. FOR THE AVOIDANCE OF DOUBT, UNLESS OTHERWISE EXPRESSLY AGREED, THE FEATURE IS PROVIDED AS-IS AND WITHOUT ANY WARRANTY OR INDEMNITY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COUCHBASE DOES NOT MAKE ANY WARRANTY AS TO THE FEATURE OR FEATURE OUTPUT. YOU UNDERSTAND AND AGREE THAT ANY USE OF THE FEATURE, INCLUDING FEATURE OUTPUT, IS AT YOUR SOLE RISK.

5. 소유권.

  1. 고객과 카우치베이스 간에, 카우치베이스 및 해당 라이선스 제공자는 기능(이에 대한 모든 개선, 향상 또는 수정을 포함)과 관련 문서에 대한 모든 권리, 소유권 및 이익(그 안의 모든 지적 재산권을 포함)을 보유하며, 본 약관의 어떠한 조항도 고객에게 그러한 라이선스 또는 기타 권리를 묵시, 묵인, 금반언 또는 기타 방식으로 부여하는 것으로 해석되지 않습니다. 이로써 카우치베이스는 본 계약의 제한 사항에 따라 고객에게 기능을 사용할 수 있는 제한적이고 비독점적이며 전 세계적인 권리 및 라이선스를 부여합니다.
  2. 고객과 카우치베이스 사이에서 고객은 고객 입력 및 기능 출력에 대한 모든 권리, 소유권 및 이권을 보유합니다. 고객은 본 계약에 따라 기능 및 아카펠라를 제공하고 개선하기 위해, 그리고 카우치베이스의 내부 비즈니스 목적을 위해 고객 입력 또는 기능 출력에 기반한 파생 저작물을 사용, 표시, 호스팅, 복사, 처리, 보관, 전송, 수정 또는 생성할 수 있는 영구적이고 비독점적이며 로열티가 없는 전 세계 권리 및 라이선스를 카우치베이스에 부여합니다. 고객은 그러한 권리 및 라이선스를 제공할 권리가 있음을 진술하고 보증하며, 고객 입력 자체나 고객 또는 Couchbase가 본 약관 또는 계약에 따라 허용된 목적으로 이를 사용하는 것이 관련 법률을 위반하거나 지적 재산권 또는 개인정보 보호권을 포함한 제3자의 권리를 침해, 오용 또는 달리 위반하지 않음을 보장해야 합니다.

6. 수수료. 귀하는 기능 사용과 관련된 모든 요금을 포함하여 계약 조건에 따라 귀하의 계정에 청구되는 모든 요금을 지불하는 데 동의합니다. 카우치베이스는 언제든지 기능과 관련된 요금 및 가격을 변경할 수 있으며, 그러한 가격 변경은 즉시 효력을 발휘합니다.

7. 수정. 당사는 당사의 단독 재량에 따라 수시로 본 약관과 기능에 대한 액세스 및 기능을 수정하거나 업데이트할 수 있으므로 정기적으로 본 약관을 검토하시기 바랍니다. 그러한 변경 후에도 기능을 계속 사용하면 본 약관의 모든 수정 사항을 수락하는 것으로 간주됩니다.
