Estos Términos específicos de las funciones de Couchbase Capella (“Términos") regulan el uso que usted hace de determinadas características y funcionalidades (cada una de ellas, un "Característica") accesible en o a través del Servicio en la Nube Couchbase Capella ("Capella”). By accessing or using a Feature, you agree to these Terms on behalf of the applicable entity or organization you represent. These Terms are incorporated by reference into the executed agreement between you and Couchbase, Inc. (“Couchbase," "nosotroso "us”) which governs your use of Capella, if applicable, or otherwise the Master Service Agreement and Capella Supplement available at https://www.couchbase.com/legal/agreementsactualizados periódicamente (en cada caso, los "Acuerdo"). I. Artificial Intelligence Functionalities

This section applies to artificial intelligence functionalities accessible in or through Capella, including those currently branded as Capella iQ and Capella AI Data Plane.

2. Uso de la función.

1. Depending on how you configure and use Capella and the Feature, Couchbase shall transmit Customer Input to an LM offered by a third-party service provider, an LM embedded within Capella, and/or an LM that you connect to Capella. Couchbase may modify Customer Input by conveying additional directions or context to the LM.
2. Until further notice and notwithstanding anything to the contrary in the Agreement, unless you purchase an applicable support entitlement (e.g., for a current AI Data Plane subscription) the Feature is provided without support or performance guarantees of any kind. This means Feature downtime shall not be included in Downtime and therefore shall not result in eligibility for Service Credits.
3. Without limiting the generality of the Agreement, you may not: (i) use the Feature in a way that infringes, misappropriates, or violates any person’s rights or violates any usage guidelines (including any applicable LM provider terms of use), or to perform or facilitate dangerous, illegal, or malicious activities; (ii) reverse assemble, reverse compile, decompile, translate, or otherwise attempt to discover the source code or underlying components of models, algorithms, or systems of the Feature (except to the extent such restrictions are contrary to applicable law); (iii) use Feature Output to train or develop models that compete with Couchbase software or compete with any associated machine learning models or related technology; (iv) use any automated or programmatic method to extract data or output to from the Feature, including distillation, scraping, web harvesting, or web data extraction; (v) represent that Feature Output was human-generated; or (vi) send Couchbase any (I) personal information of children under the age of 13 or otherwise under the applicable age of digital consent, or (II) information that includes or constitutes “Protected Health Information,” as defined under the HIPAA Privacy Rule (45 C.F.R. Section 160.103), in each case without prior written agreement by us.
4. Usted acepta que, si utiliza la Función para procesar cualquier dato personal, entonces: (i) usted da instrucciones a Couchbase y a sus proveedores de servicios externos para procesar dichos datos personales; (ii) la DPA incorporada en el Acuerdo se aplicará al procesamiento de dichos datos personales por parte de Couchbase; y (iii) usted acepta que los proveedores de servicios externos utilizados para proporcionar la Función se añaden por la presente como Subprocesadores autorizados (tal y como se define dicho término en la DPA).

3. Responsabilidad por las aportaciones de los clientes.

1. Usted es el único responsable de las aportaciones de los clientes, y declara y garantiza que dispone de todos los derechos y licencias necesarios para enviarlas.
2. You are solely responsible for determining whether you will use an LM in connection with your use of Capella, and for establishing and enforcing policies and procedures regarding how your Authorized Users access and use the Feature.

4. 4. Responsabilidad por el uso de las prestaciones y exención de garantía.

1. You are solely responsible for reviewing and determining whether and how to use Feature Output.
2. You acknowledge that (i) use of LMs and the Feature may involve risks, including the generation of inaccurate or harmful outputs; (ii) the Feature may generate content that does not reflect Couchbase’s views; (iii) Couchbase does not review or evaluate the quality or accuracy of Feature Output; and (iv) Couchbase makes no representations or warranties regarding the quality or accuracy of Feature Output. Feature Output may not be unique across users and the Feature may generate the same or similar output for a third party. FOR THE AVOIDANCE OF DOUBT, UNLESS OTHERWISE EXPRESSLY AGREED, THE FEATURE IS PROVIDED AS-IS AND WITHOUT ANY WARRANTY OR INDEMNITY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COUCHBASE DOES NOT MAKE ANY WARRANTY AS TO THE FEATURE OR FEATURE OUTPUT. YOU UNDERSTAND AND AGREE THAT ANY USE OF THE FEATURE, INCLUDING FEATURE OUTPUT, IS AT YOUR SOLE RISK.

5. Derechos de propiedad.

1. Como entre el Cliente y Couchbase, Couchbase y sus licenciantes retienen todos los derechos, títulos e intereses en y para la Característica (incluyendo cualquier y todas las mejoras, mejoras o modificaciones a la misma), así como la Documentación asociada, incluyendo todos los derechos de propiedad intelectual en el mismo, y nada en estos Términos se interpretará como una concesión por implicación, aquiescencia, impedimento, o de otra manera, cualquier licencia u otro derecho sobre el Cliente. Por la presente, Couchbase concede al Cliente un derecho y una licencia limitados, no exclusivos y mundiales para utilizar la Característica, sujetos a las restricciones del Acuerdo.
2. Como entre el Cliente y Couchbase, el Cliente retiene todo derecho, título e interés en y para la Entrada del Cliente y la Salida de Características. Por la presente, el Cliente otorga a Couchbase un derecho y licencia perpetuos, no exclusivos, libres de regalías y a nivel mundial para usar, mostrar, alojar, copiar, procesar, archivar, transmitir, modificar o crear cualquier trabajo derivado basado en la Entrada del Cliente o la Salida de la Característica para proporcionar y mejorar la Característica y Capella de conformidad con el Acuerdo, así como para los fines comerciales internos de Couchbase. El Cliente representa y garantiza y se asegurará de que tiene el derecho de proporcionar tal derecho y licencia y que ni la Entrada del Cliente en sí misma ni su uso por el Cliente o Couchbase para fines permitidos bajo estos Términos o el Acuerdo violará ninguna ley aplicable o infringirá, malversará o violará cualquier derecho de terceros, incluidos los derechos de propiedad intelectual o derechos de privacidad.

6. Tasas. Usted se compromete a pagar todos los cargos cargados a su cuenta de acuerdo con los términos del Acuerdo, incluyendo cualquier cargo relacionado con el uso de la Función. Couchbase puede cambiar los cargos y precios asociados con la Característica en cualquier momento, y cualquier cambio de precios será efectivo inmediatamente.

7. Modificaciones. Es posible que modifiquemos o actualicemos estas Condiciones, así como el acceso y la funcionalidad de la Función, de vez en cuando y a nuestra entera discreción, por lo que le recomendamos que revise estas Condiciones periódicamente. El uso continuado de la aplicación después de cualquier cambio constituye su aceptación de cualquier modificación de estos Términos.
